Reference: NRS-Y13-0749
Type: Proposed Convention resolution, circulated for debate
Sponsoring delegates: Jalen Mire and Tomas Rell
Date: Year 13, Month 12
Status: Not adopted at filing
Purpose and scope
The sponsors present this proposal under §15.5.a(3) as one resolution addressing the two certified petitions together. It would permit a geographically limited northern part of the original certified lake corridor to pursue merger with Kelvant while retaining the southern lakefront within Korda. The remaining Territory would continue to pursue the Statehood process subject to §15.2. This proposal substitutes for neither affected-voter ratification nor the constitutional approvals required for merger or Statehood.
Article 1 — Scheduled geography
Proposed transfer area: only the three existing northern electoral districts identified in the certified corridor-petition district register as LC-N1 (Varenne Station), LC-N2 (Upper Lake Road) and LC-N3 (North Freight Landing), using their fixed boundaries on the Elections Panel's certification-date district map. These identifiers are used in this proposed schedule for the first time; the Elections Panel is requested to authenticate the corresponding original district descriptions and publish the map schedule with the referendum materials. The Convention may not substitute current transport catchments for those fixed electoral boundaries.
Proposed retained area: all other Korda districts, including every southern lake district within the certified corridor petition and the whole interior, remain in Korda. No proposed boundary removes Korda's southern Lake Varda frontage or its existing southern public-access routes.
The district identifiers and certification-date boundaries in this Article, not any illustrative website atlas crop, govern what the Convention proposes. No land or jurisdiction changes status upon filing or adoption by the Convention alone.
Article 2 — Continuity of public services
Any resulting implementation agreement must identify an accountable operator for each affected public transport link, water access, emergency service, public facility and shared-service contract from the moment jurisdiction changes. Existing services remain under their lawful current operators until lawfully transferred or succeeded. The agreement must protect continued access for residents and users on both sides, including existing community and Indigenous lake relationships, without purporting to define those traditions through transport statistics.
Article 3 — Assets and liabilities
A joint transition schedule shall distinguish legal title, operating duty, service area, existing contractual obligation and any agreed new cost allocation. Outstanding archival title entries, contract amendments and shared costs expressly identified in NRS-Y13-0746 remain unresolved. They must be documented and settled through lawful implementation and review, not assigned by estimation or treated as proof that one jurisdiction owns an asset. No commitment is imposed on Kelvant absent its constitutionally required approval and a lawful implementing agreement.
Article 4 — Statehood of the remainder
The certified whole-Korda Statehood petition is addressed by preserving a continued proceeding for the remaining Territory on its eventual boundaries, subject to all applicable §15.2 audits, time limits and capacity findings. No audit is deemed passed, no State is created, and no constitutional deadline is extended by this resolution. The responsible Monitors must evaluate the actual jurisdiction that would seek Statehood; incomplete or outdated findings cannot be represented as successful certification.
Article 5 — Conditional constitutional route
Adoption by the Convention would establish only its proposed resolution. The Elections Panel must administer the referendum required by §15.5.a(3) among eligible voters affected by the resolution, with the merger conditions of §15.4 observed. A merger additionally requires approval through Kelvant's constitutional process, joint LM–JM confirmation of Kelvant's constitutional integrity, and Senate ratification by simple majority. The affected Territory's Statehood proceeding remains separately subject to §15.2. No boundary transfer or Statehood occurs until all steps applicable to that act have been completed.
Article 6 — Deliberative status
This text is submitted for Convention consideration. It carries no adopted vote, does not restart the ninety-day Convention period, and does not revive either referendum displaced when the competing petitions entered §15.5.a. Further amendments may be published and recorded before a final Convention vote.
End of proposed record.
