Notice of Reconvening — Joint Committee on Fiscal Equalization

Record Identification

NRS Reference:NRS-Y13-0710
Record Type:Committee scheduling and agenda notice
Filing Authority:Joint Committee on Fiscal Equalization — Chair Renata Kell
Date of Filing:Year 13, Month 12

Notice

The Joint Committee on Fiscal Equalization will reconvene during Month 12 to continue the statutory review of the equalization mechanism maintained under §12.6.

The committee's prior request to the Executive Monitor resulted in NRS-Y13-0402, which certified that the mechanism was operating as the Legislature had defined it by statute and did not find a failure within the meaning of §12.6. That certification therefore did not trigger the ninety-day legislative-response requirement.

The absence of a failure finding does not prevent the Legislature from reviewing or amending the statutory mechanism through the ordinary legislative process.

Agenda

The reconvened session will consider:

  1. the interval data published with NRS-Y13-0402, including the widening difference between Territory and disadvantaged-State request-to-funding times;
  2. the number and age of capacity requests pending for more than three years;
  3. whether the current statutory formula should account for request age, sustained service burdens, infrastructure backlog, or other measurable capacity factors not presently reflected in the mechanism;
  4. submissions from affected States and Territories concerning the practical operation of the current mechanism; and
  5. whether to report proposed statutory language, recommend no amendment, or request additional evidence before proceeding.

Submissions

The committee clerk will receive written submissions from State and Territory governments, the Civic Consul's fiscal administration, the Territorial Infrastructure ministry, and other public bodies with direct responsibility for data relevant to the mechanism. Submissions will be entered in the committee record subject to lawful protection of personal or otherwise protected information.

No submission is treated as the committee's position merely by being received.

Constitutional Status

This notice records a legislative review of a statutory mechanism required by §12.6. It does not constitute an Executive Monitor failure finding, does not commence a new ninety-day constitutional response period, and does not authorize the committee to alter the mechanism without legislation enacted through the ordinary constitutional process.
