The Executive Monitor is not limited by §12.8 to a binary certification and includes the following data as context for the Legislature's own consideration, without characterizing it as a failure finding.

The gap between the Territory median and the disadvantaged-State median has widened in each of the last four annual certifications. The mechanism's formula does not distinguish between a request that clears in two years and one that clears in six; both are recorded identically as "funded." This certification is the first to include the underlying interval data rather than the funding outcome alone, at the Joint Committee's specific request.
Because no failure is found, the 90-day Legislative response period under §12.8 is not triggered. The supplementary data is provided for the Joint Committee's use in its ongoing review and does not itself require any legislative act.
