Constitutional Basis
Following an EM finding that the fiscal equalization mechanism has failed, the Monetary Authority must submit a remedy plan to the Civic Consul and the Speaker of each chamber within 30 days, published to the NRS. NRS-Y13-0047 was published Year 13, Month 1, Day 29. This submission is timely under §12.8.
Findings Summary
The MA has reviewed the conditions identified in NRS-Y13-0047. The Executive Monitor's interim fiscal review found that Korda Territory's social state indicators have deteriorated below the constitutional minimum threshold under the fiscal equalization formula: social support programs at 61% of minimum adequacy; emergency housing at 34%; coast guard operations at 312% of normal operational costs due to Lake Varda displacement flows. The equalization formula, as currently calibrated, does not produce a sufficient transfer to address simultaneous below-threshold performance across multiple social indicators while the territory carries emergency operational costs that were not anticipated at formula design. This is a mechanism failure, not a fiscal administration failure within Korda.
Remedy Plan
The MA proposes the following to restore the equalization mechanism to constitutional adequacy for Korda Territory: 1. EMERGENCY SUPPLEMENTAL TRANSFER. An immediate supplemental transfer to Korda Territory calculated to bring social support and emergency housing indicators to minimum threshold. The MA calculates this at 2.3% of the prior year's federal discretionary allocation. This transfer does not require formula revision and can be executed within the existing statutory framework upon Assembly authorization. 2. FORMULA RECALIBRATION REVIEW. The current formula does not contain a displacement-event modifier. Where a territory is absorbing population movement resulting from an external emergency (§6.3 asylum filings are active), operating costs diverge from formula assumptions. The MA recommends the Legislature commission a formula review with a 180-day reporting deadline. 3. COAST GUARD OPERATIONAL COSTS. The 312% operational cost figure reflects Lake Varda response activity that falls within the Legat Consul's domain. The MA notes that the EM's finding did not disaggregate this cost from the social state calculation. The MA recommends the Legislature and both executives jointly determine whether coast guard costs in active humanitarian response should be excluded from the territorial fiscal floor calculation.
Legislative Response Window
The Legislature's 90-day response period under §12.8 (running from NRS-Y13-0047, Year 13 Month 1 Day 29) closes Year 13, Month 4, Day 29. This remedy plan does not extend or modify that deadline. The MA will publish a compliance status report at the close of the legislative response period regardless of whether the Legislature has acted.
