The Third Strike

Year 15. Valdrath fails its third consecutive biennial Statehood Audit. The Monitors certify the sequence to the Senate, which authorizes Provisional status. Federal-State advisers support remediation without governing authority; a referendum on pursuing devolution follows when the first sitting senator’s term expires.

§15.1.a Provisional Status §15.2 The Statehood Audit §15.3 State Remediation and Mandatory Devolution Review §15.4 Voluntary Devolution and Merger §4.5 Judicial Review and Scope

Valdrath had been on Statehood Watch since Year 11. The LM found material failures in electoral legislation, the EM in election administration, and the JM published its own domain findings. The next scheduled audit in Year 13 found that some defects had been corrected but still produced material failures from the LM and EM. Each overall failed audit brought an Early Warning and a required Remediation Plan, revised after the second consecutive failure.

Year 15’s audit found continuing material failures in both the LM and EM domains: legislation still failed to supply lawful electoral safeguards, and certification software in three districts remained outside NVS technical standards. The State passed emergency legislation on publication morning. Each Monitor nonetheless published the conditions found during the audit period; prospective legislation had not cured them. Two material-failure findings established the third consecutive overall failure.

What Follows Three Failures

§15.3 — Senate Review
The third failure requires a political decision. The audit does not change Valdrath's status by itself.

The Monitors certified the three-failure sequence to the Senate and published the certification to the NRS. The Senate then voted by absolute majorityA majority of a chamber's full seated membership — counted against every seat filled, not just the members present or voting. of its full seated membership to place Valdrath in Provisional status. Only that affirmative vote changed the State's political status.

Valdrath remained a State under §15.1.a. Its legislature, courts, executive, Article I protections, social-state access, and Assembly representation continued. Sitting senators completed their current terms, but no new Senate term could begin while Provisional status continued. The path back to ordinary State status required two consecutive biennial audits with no material-failure finding from any Monitor.

Advisory Cooperation

§15.3 — Remediation Support
The Republic and Valdrath choose a small advisory working group. Its form is not prescribed by the Constitution.

During remediation after the failed audit, the Republic and Valdrath agreed to a four-person working group: two federal representatives and two State representatives. That composition came from their agreement, not from §15.3.

The group reviewed published audit findings, advised on remediation, and coordinated access to federal technical expertise. It held no political, legal, auditing, or governing authority over Valdrath. The State legislature alone decided what laws to pass and what reforms to implement.

Advisory Working Group · First Publication · Year 15 · Valdrath

The group reviewed the published audit findings and advised that the Electoral Integrity Restoration Act addressed the correct failure point but that its 18-month implementation timeline could be shortened. It recommended prioritizing Districts 4, 9, and 11 and coordinating certification testing with Elections Panel technical staff.

Those recommendations were advice only. Valdrath remained free to accept, modify, or reject them.

The Forced Devolution Election

§15.3 — Citizen Vote on Devolution
The Elections Panel administers a citizen vote on pursuing devolution. The terms are identical to §15.4's voluntary process.

The first sitting senator’s term expired in Year 17. At that point the Elections Panel administered the required referendum on pursuing devolution. Approval required 60% of votes cast and at least 50% participation. An affirmative result would begin negotiation between the State and the Legislature, followed by Senate ratification of the restructuring agreement by two-thirds of full seated membership. It would not turn Valdrath into a Territory immediately.

At 68% turnout, 71% of votes cast rejected pursuing devolution. Valdrath remained a Provisional State and continued remediation. If that status persisted, another referendum would follow at a two-year interval. Devolution would restructure the State’s relationship within the Republic; it was not a vote to leave the Republic.

The SC Challenge and Resolution

§15.3 — Judicial Review
Valdrath challenges application of the audit criteria. Judicial review cannot substitute policy judgment for Monitor assessment.

Valdrath’s Governor filed a judicial challenge on Day 21, alleging that the audit criteria had been incorrectly applied. §15.3 permits review of legality, process, jurisdiction, and application of the stated criteria; it supplies no special 30-day filing limit or factual-sufficiency-only restriction. The Court examined the claimed error without substituting its policy judgment for the Monitors’ domain assessments. It dismissed the challenge because prospective legislation had not remedied the material failures found in the audited period.

Year 17

Valdrath's legislature amended the Electoral Integrity Restoration Act's implementation timeline to 90 days after considering the advisory group's recommendations. The group published a follow-up advisory note. The Elections Panel's technical staff worked alongside Valdrath's election administrators through the summer. By the time the Year 17 audit team arrived, Districts 4, 9, and 11 were running on certified NVS software.

The Year 17 audit produced no material-failure finding from any of the three Monitors. Year 19 did the same. Publication of the complete second clean biennial audit restored ordinary State status automatically. The advisory arrangement then ended. No admission vote or executive confirmation was required. The bar on beginning new Senate terms ended.

The devolution referendum gave citizens a say at the constitutionally specified point. The advisory mechanism proposed remedies, and the State legislature retained authority to enact them. Two consecutive fully clean biennial audits ended Provisional status. Valdrath had remained a State throughout.
