## **ARTICLE I — DECLARATION OF RIGHTS**

### §1.1 — Inherent Rights

All persons within Aldenmere hold the rights guaranteed under Article I of the Constitution of the Federated Republic. This Constitution may expand but may not diminish those rights.

### §1.2 — Equal Protection

### §1.3 — Due Process

### §1.4 — Freedom of Expression and Assembly

The rights of speech, press, peaceful assembly, and petition may not be abridged. The Legislature may regulate the time, place, and manner of assembly for compelling public safety purposes, but may not discriminate on the basis of viewpoint.

---

## **ARTICLE II — THE EXECUTIVE BRANCH**

### §2.1 — The Governor

**(a) Election and Term**
The executive authority of Aldenmere is vested in a Governor, elected by the citizens of Aldenmere for a term of four years. Elections are held in even-numbered years not coinciding with federal Legat Consul elections.

**(b) Eligibility**
To hold the office of Governor, a person must:
- Be a citizen of the Federated Republic;
- Have been a resident of Aldenmere for at least five years immediately preceding the election;
- Be at least 30 years of age at the time of taking office.

**(c) Term Limits**
No person may serve more than two consecutive terms as Governor. A person who has served two consecutive terms may seek the office again after sitting out one full term.

### §2.2 — Executive Powers and Duties

The Governor holds authority over:
- The State civil service and all executive agencies;
- Preparation and submission of the annual State budget to the Legislature;
- Faithful execution of all laws enacted by the Legislature and all applicable federal laws;
- Appointment of department heads, agency directors, and members of boards and commissions, subject to Senate confirmation as provided in this Constitution;
- Negotiation of compacts and agreements with other States, Territories, and the federal government, subject to legislative ratification;
- Command of the State Guard, subject to federal authority under Article XIV of the federal Constitution.

### §2.3 — Executive Departments

The Legislature shall by statute establish executive departments responsible for the administration of State functions. At minimum, the following departments must be established:

- **Department of Education**
- **Department of Health and Social Services**
- **Department of Transportation and Infrastructure**
- **Department of Economic Development**
- **Department of Environmental Protection**
- **Department of Public Safety**

Each department is led by a Secretary appointed by the Governor and confirmed by the Senate by simple majority. Secretaries serve at the pleasure of the Governor.

Where the office of Secretary is vacant or a nominee is pending confirmation, an otherwise qualified State civil-service employee of that department serves as Acting Secretary as provided by law. Absent such law, the qualified employee with the longest continuous service in the department serves as Acting Secretary; where continuous service is equal, the oldest qualified employee serves. Acting service ends when a permanent Secretary takes office.

### §2.4 — Legislative Veto

The Governor may veto any bill passed by the Legislature by returning it within ten business days of passage with a written statement of objections. The Legislature may override the veto by a 2/3 vote of both chambers.

Where the Governor neither signs nor vetoes a bill within ten business days of passage, the bill becomes law by operation of this Constitution.

### §2.5 — Line-Item Veto

The Governor may veto individual line items in appropriations bills while signing the remainder. A line-item veto may be overridden by 2/3 vote of both chambers.

### §2.6 — Succession and Incapacity

**(a) Lieutenant Governor**
A Lieutenant Governor is elected on the same ticket as the Governor. Upon the Governor's death, resignation, removal, or permanent incapacity, the Lieutenant Governor becomes Governor for the remainder of the term. During the Governor's temporary incapacity, the Lieutenant Governor serves as Acting Governor until the incapacity ends.

**(b) Speaker of the Assembly**
Where neither the Governor nor Lieutenant Governor is able to succeed or serve by reason of vacancy or permanent incapacity, the Speaker of the Assembly, if eligible and willing to serve, becomes Governor for the remainder of the term. Where the Governor is temporarily incapacitated and the Lieutenant Governor is unable to serve, the Speaker serves as Acting Governor until the incapacity ends.

**(c) Acting Succession and Special Election**
Where none of the Governor, Lieutenant Governor, or Speaker of the Assembly is able and eligible to exercise the office, the President of the Senate serves as Acting Governor. Further acting succession is established by law. Absent such law, succession passes first to qualified heads of executive departments in order of longest continuous service as a department head, with age breaking a tie, and then to qualified legislative officers in an order established by the rules of their respective chambers. An eligible successor may decline to serve, in which case the next eligible person serves.

Where a permanent vacancy in the office of Governor reaches the acting succession provided by this subsection, a special gubernatorial election shall be held within the period established by law, or, absent such law, within 120 days. The person elected serves the remainder of the term.

**(d) Lieutenant Governor Vacancy**
A vacancy in the office of Lieutenant Governor shall be filled as provided by law. Until filled, the succession provisions of this section operate as though the office were vacant.

**(e) Incapacity**
The determination and termination of temporary incapacity, and the determination of permanent incapacity, are governed by law. Restoration from temporary incapacity ends acting authority automatically.

**(f) Separation of Offices**
A person serving as Acting Governor may not exercise the powers of another public office while acting, but retains the underlying office unless otherwise provided by this Constitution. A Speaker who becomes Governor under subsection (b) vacates both the office of Speaker and their Assembly seat.

### §2.7 — Removal

The Governor may be removed from office by:
- Recall election initiated by petition of 15% of registered voters and approved by simple majority in a State referendum; or
- Legislative impeachment by 2/3 vote of both chambers on grounds of constitutional breach, criminal conviction, or demonstrated permanent incapacity.

The Assembly consists of members elected from single-member districts apportioned by population. The number of Assembly districts shall be established by statute, but may not be fewer than 40 nor more than 80.

**(b) Apportionment**
Assembly districts are redrawn every ten years following the State census. Districts must be:
- Approximately equal in population;
- Geographically contiguous;
- Reasonably compact;
- Drawn without intentional dilution of minority voting power.

The State Redistricting Commission, established under §3.7, draws all Assembly district maps.

**(c) Term**
Assembly members serve two-year terms. No term limits apply.

**(d) Leadership**
The Assembly elects a Speaker from its own members by simple majority at the commencement of each two-year session and whenever the office becomes vacant. The Speaker presides over Assembly proceedings and appoints committee chairs.

### §3.3 — The Senate

**(a) Composition**
The Senate consists of members elected from multi-member regional districts. The number of Senate districts and the number of senators per district shall be established by statute, but the total number of senators may not be fewer than 20 nor more than 40.

**(b) Apportionment**
Senate representation shall be apportioned so that the population represented by each Senate seat is approximately equal throughout the State. Senate districts must be geographically contiguous, reasonably compact, and drawn without intentional dilution of minority voting power. Changes to the number of Senate districts or seats per district take effect only with the next regularly scheduled redistricting.

The State Redistricting Commission, established under §3.7, draws all Senate district maps.

**(c) Term**
Senators serve four-year staggered terms. At the first seating of the Senate under this Constitution, half of all senators are assigned by lot to initial two-year terms; thereafter all Senate terms are four years. No term limits apply.

**(d) Leadership**
The Senate elects a President from its own members by simple majority at the commencement of each four-year cycle and whenever the office becomes vacant. The President presides over Senate proceedings and appoints committee chairs.

### §3.4 — Legislative Process

A bill becomes law upon:
- Passage by simple majority of each chamber; and
- Signature of the Governor, override of the Governor's veto, or passage of ten business days without gubernatorial action.

**(c) Single Subject**
Every bill must address a single subject, clearly expressed in its title. A bill addressing multiple unrelated subjects is void.

**(d) Public Access**
The full text of every bill must be published and available to the public for at least 72 hours before any final passage vote. A bill substantially amended after initial publication must be republished and the 72-hour period resets.

### §3.5 — Fiscal Responsibility

**(a) Balanced Budget Requirement**
The Legislature must pass a balanced budget annually. Total appropriations may not exceed projected revenue as certified by the State Auditor.

**(b) Emergency Deficit Spending**
The Legislature may authorize deficit spending only:
- In response to an emergency declared by the Governor or determined by 2/3 vote of both chambers;
- With 2/3 approval of both chambers;
- For a period not to exceed two consecutive fiscal years, whether under the same or successive emergency declarations or determinations;
- With a published plan for return to balance.

**(c) Budget Deadline**
The Legislature must pass the annual budget before the start of the fiscal year. Where the Legislature fails to do so, the prior year's budget continues at the same funding levels, adjusted for inflation as certified by the State Auditor, until a new budget is enacted.

### §3.6 — Confirmation Authority

The Senate holds exclusive authority to confirm or reject:
- All executive department Secretaries by simple majority;
- All judges of the Supreme Court and appellate courts by 2/3 vote;
- Members of independent boards and commissions as specified by statute.

- Two appointed by the Governor;
- Two appointed by the Speaker of the Assembly;
- Two appointed by the President of the Senate;
- One selected by the other six members to serve as Chair.

No member may be a current elected official, lobbyist, or party official. Members serve a single term of ten years.

The six appointed members shall select the Chair within the period established by law, or, absent such law, within 30 days after the sixth member takes office. If they fail to do so, the State Elections Commission shall conduct a public selection by lot from qualified applicants meeting the eligibility requirements of this subsection.

**(b) Mandate**
The Commission draws all Assembly and Senate district maps following each decennial census. Assembly maps must comply with §3.2(b); Senate maps must comply with §3.3(b). The Commission publishes draft maps for public comment before final adoption.

**(c) Judicial Review**
Any citizen may challenge an adopted map before the State Supreme Court within 30 days of adoption on the grounds that the map violates the applicable constitutional criteria. Where a map is invalidated, the Commission shall adopt a corrected map within the period established by law, or, absent such law, within 30 days of the Court's judgment.

### §3.8 — Vacancies, Quorum, and Voting

**(a) Legislative Vacancies**
Vacancies in either chamber shall be filled as provided by law. Absent such law, a special election shall be held within 90 days of the vacancy.

**(b) Quorum**
A majority of the authorized membership of a chamber constitutes a quorum.

Justices are appointed by the Governor from a pool of qualified candidates maintained by the Judicial Nominating Commission, confirmed by 2/3 vote of the Senate, and serve a single non-renewable term of twelve years.

To serve on the Supreme Court, a person must:
- Be a licensed attorney with at least fifteen years of legal practice or judicial service;
- Be a resident of Aldenmere at the time of appointment.

**(d) Acting Justice**
During a vacancy on the Supreme Court, the qualified judge with the longest continuous service on the highest lower court serves as Acting Justice; where continuous service is equal, the oldest qualified judge serves. An Acting Justice retains the underlying judicial office while temporarily assigned and does not exercise its powers during the assignment. Statute may establish another objective order of acting succession.

### §4.6 — Judicial Conduct Commission

**(a) Independence and Composition**
An independent Judicial Conduct Commission shall administer judicial discipline. Its composition and appointment are established by law and must include judges, licensed attorneys, and members of the public who are not judges or attorneys. No branch of State government or professional class may control a majority of the Commission. Members serve fixed terms and continue in office until their successors qualify unless removed for cause as provided by law.

**(b) Mandate**
The Commission shall adopt and publish a Code of Judicial Conduct as provided by law and may investigate and discipline judges for violations of that Code. Available discipline may include reprimand, censure, suspension, and, for judges other than Supreme Court justices, removal. Removal by the Commission requires a 2/3 vote.

**(c) Due Process and Review**
No discipline may be imposed without written notice of the charges, an opportunity to respond and present evidence, an impartial hearing, and a written decision stating the grounds. Commission decisions are subject to judicial review. A justice who is the subject of a proceeding may not participate in its review; where the Supreme Court cannot constitute an impartial quorum, review proceeds as provided by law.

### §4.7 — Judicial Review

### §11.3 — State Elections Commission

**(a) Independence**

Members serve fixed terms; no current elected official or party official may serve; and no single appointing authority may appoint or control a majority of the Commission.

**(b) Certification and Review**
Certification is a ministerial act based solely on the final lawful vote count and applicable constitutional and statutory eligibility requirements. Electoral disputes are subject to judicial review as provided by law. Where the Commission is unable to perform a constitutionally required certification, the State Supreme Court may order certification upon verification of the lawful result.

### §11.4 — Continuity of Government

A denial shall state its precise legal ground in writing.
